Case Study: Alternative Dispute Resolution

ECOTEC have been commissioned by the Ministry of Justice to evaluate a pilot project which is testing out Alternative Dispute Resolution techniques in Disability Living Allowance and Attendance Allowance appeals in the Social Security and Child Support Appeals Tribunal.

Alternative Dispute Resolution is the collective term for the ways that parties can settle civil disputes, with the help of an independent third party and without the need for a formal court or tribunal hearing. The overall aim of ECOTEC's evaluation is to determine the extent to which the ADR arrangements of the pilot exercise - namely the Early Neutral Evaluation technique - results in any benefits/efficiencies for the tribunal and for the appellants.

Our approach to the evaluation includes the analysis of management data and qualitative interviews with Tribunal Service staff, Disability and Carers Service staff, appellants and other user groups and stakeholders.
